Domestic Violence

Maternal domestic violence is alarmingly common. Current literature suggests that in the general population, 13% to 30% of women have been involved in an abusive relationship at some time in their lives. Domestic violence can be physical, sexual, or emotional.
Legal Protection:
Mandatory Arrest Law:
- Primary Aggressor can be arrested up to 24 hours after a battery has occurred.
- Relationship to primary aggressor through marriage, dating, or child in common.
- The victim does not have to press charges. Law enforcement makes the arrest.
- Bail cannot be posted for 12 hours.
Protection Orders (TPO)
- An order from the court for the abuser to stop hurting, threatening, and harassing the victim.
- Lasts up to 30 days.
- An attorney is not needed.
- No filing fees.
- Violation does not need to be witnessed by officer for an arrest.
- Contact Court Master at 665 West Silver, Elko, NV, to file.
- Extended TPO's for up to one year are available.
Stalking Law
Nevada has laws against stalking.
Sexual Assault is:
- A violent act, NOT out of sexual desire.
- Committed against your will.
- Done in order to control and humiliate.
- Involves threat of force or use of force.
If you are raped:
- Get to a safe place.
- Do NOT wash, douche, or change clothes
- Get medical attention immediately.
- Call 911 to report the crime. You have the right to use a pseudo-name.
- Call CADV for support and help.
Marital Rape: Marriage cannot be used as a defense against sexual assault.
